Terms & Conditions

These Terms & Conditions (the “Terms”) form a binding agreement between you (“you,” “user”) and Boothtime LLC (“Boothtime,” “we,” “us,” or “our”), the operator of the ThetaForge application, website, and related services (collectively, the “Service”). By downloading, installing, accessing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About ThetaForge
ThetaForge is a self-directed audio-based experience that combines spoken affirmations, soundbeds, drones, pacing, and optional binaural pulse layers into intentional sessions designed to support behavioral repatterning. ThetaForge is provided strictly as an educational and self-improvement tool. It is not a medical device, a therapy, a diagnostic, or a substitute for professional mental health or medical care.
2. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that your use of the Service does not violate any applicable law.
3. Not Medical Advice; Mental Health Disclaimer
The Service is not medical advice and does not create a therapist-patient, doctor-patient, or any other clinical relationship. Content delivered through the Service (including affirmations, audio sessions, AI-generated sessions, and any associated material) is intended for general informational and self-reflective use only. It is not designed to diagnose, treat, cure, mitigate, or prevent any disease, disorder, injury, or psychological condition.
You should not use the Service, and you agree not to rely on the Service, as a substitute for evaluation or treatment by a licensed healthcare professional. You should consult a qualified professional before using the Service if you:
- have been diagnosed with, or are experiencing symptoms of, any psychiatric, neurological, or psychological condition, including but not limited to depression, anxiety, bipolar disorder, schizophrenia, dissociative disorders, post-traumatic stress disorder, obsessive-compulsive disorder, eating disorders, psychosis, or substance use disorders;
- have a history of seizures, epilepsy, photosensitivity, or any condition that may be affected by audio entrainment, binaural pulse stimuli, or repetitive auditory content;
- are pregnant, recovering from a head injury, or using a pacemaker or other implanted medical device;
- are currently in crisis, experiencing suicidal ideation, self-harm urges, or homicidal ideation; or
- are taking medication, undergoing therapy, or following any treatment plan that could be affected by self-directed audio interventions.
If you are in crisis or believe you may harm yourself or others, stop using the Service immediately and contact your local emergency services, or call or text a crisis line such as 988 (in the United States). The Service is not designed to detect, respond to, or assist with mental health emergencies.
4. Assumption of Risk and Personal Responsibility
You acknowledge that the Service involves immersive audio (including binaural and repetitive vocal content) and self-authored or AI-assisted affirmations, and that responses to such content vary significantly between individuals. You voluntarily assume all risks associated with your use of the Service. You are solely responsible for:
- determining whether the Service is appropriate for you, given your physical and mental health;
- the content of any affirmations or prompts you provide to the Service, including those you author yourself, edit, save, or generate through AI tools;
- discontinuing use if you experience any adverse physical, emotional, or psychological reaction; and
- seeking professional help if symptoms persist or worsen.
5. Accounts and Subscriptions
Certain features of the Service require an account and a paid subscription (e.g., Basic and Premium AI Edition). You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Subscriptions auto-renew until cancelled in accordance with the cancellation flow of the platform through which you purchased them (e.g., the Apple App Store, Google Play, or our website). Free trials convert automatically to paid subscriptions at the end of the trial period unless cancelled in advance.
6. AI Features and Content Moderation
The Premium AI Edition uses third-party large language models (including services provided by OpenAI) to help generate, shape, and personalize affirmation content and session structure. AI output is probabilistic and may be inaccurate, inappropriate, or out of context. You are responsible for reviewing AI output before relying on it.
To protect users and the integrity of the Service, prompts and content submitted to or generated by the AI features may be screened in real time using automated moderation systems, including the OpenAI Moderation API. You acknowledge and agree that:
- content flagged as self-harm, suicide, sexual content involving minors, violence, harassment, hate, or other prohibited categories may be blocked, redacted, or refused;
- repeated or deliberate attempts to circumvent moderation, jailbreak the AI, or produce harmful, exploitative, or self-injurious content may result in immediate suspension or permanent termination of your account, without refund;
- moderation is an automated safety layer, not a clinical safety net, and the absence of a block does not imply that content is safe, appropriate, healthy, or therapeutically suitable for you.
7. Acceptable Use
You agree that you will not, and will not attempt to:
- use the Service to encourage, simulate, rehearse, or reinforce self-harm, suicide, eating-disordered behavior, substance abuse, violence toward others, or any unlawful conduct;
- use the Service to author, save, or generate affirmations that target another identifiable person without their consent, or that promote hatred, harassment, or discrimination;
- use the Service on behalf of a third party (including a minor or a person under your care) without authority to bind that person to these Terms;
- reverse engineer, decompile, scrape, or attempt to extract source content, audio assets, model weights, or prompts;
- use the Service to develop a competing product or to train any machine learning model;
- access the Service through automated means, or share, resell, or sublicense your account or subscription; or
- interfere with the security, integrity, or availability of the Service.
8. User Content
You retain ownership of the affirmations and prompts you author. By submitting content to the Service, you grant Boothtime a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, display, and modify that content solely as necessary to operate, secure, and improve the Service for you. We do not sell your personal affirmations.
9. Intellectual Property
The Service, including its software, audio assets, soundbeds, drones, written content, design, and the ThetaForge name and marks, is owned by Boothtime LLC or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for its intended personal, non-commercial purpose during the term of your subscription.
10. Third-Party Services
The Service relies on third-party providers (including, without limitation, OpenAI, app store operators, payment processors, and hosting providers). Your use of those features may also be subject to those providers’ terms. We are not responsible for the acts, omissions, or content of third-party providers.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Boothtime disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uninterrupted operation, and freedom from harmful components. Boothtime makes no warranty that the Service will achieve any particular psychological, emotional, behavioral, cognitive, or therapeutic outcome.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOTHTIME LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR EMOTIONAL OR PSYCHOLOGICAL HARM, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Without limiting the foregoing, Boothtime shall not be liable for any harm arising from: (a) any mental health condition, psychological response, dissociative episode, panic, mood change, intrusive thought, or behavioral consequence experienced before, during, or after use of the Service; (b) any user’s decision to use the Service in lieu of, or in addition to, professional medical or mental health care; (c) any affirmation, prompt, or content created, edited, generated, or saved by a user, including content created by a user with the intent to harm themselves or others, to circumvent safety features, or to misuse AI-assisted generation; (d) any reliance on AI-generated output; or (e) any decision, action, or inaction a user takes based on the Service.
You agree that you, and not Boothtime, are responsible for choosing to use the Service and for any consequences of that choice. If, despite the foregoing, Boothtime is found liable to you for any reason, our aggregate liability shall not exceed the greater of (i) the amount you paid to Boothtime for the Service in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Boothtime LLC and its officers, members, employees, contractors, licensors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) content you submit, save, or generate through the Service; or (d) your violation of any third-party right or applicable law.
14. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, abused the Service or its safety features, or created risk to yourself, other users, or Boothtime. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State in which Boothtime LLC is organized, without regard to its conflict-of-laws principles. Except where prohibited by law, any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction and venue of those courts. You and Boothtime each waive any right to a jury trial and agree that any dispute shall be brought in an individual capacity, not as part of a class or representative action.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
